Terms of Sale

These Terms apply to purchases made through keyshorts.com, keyshorts.eu, keyshorts.pl, and their localized versions.

The applicable mandatory consumer rights depend on the law applicable to the Consumer and not on which Keyshorts domain was used.

1. Definitions

Consumer means a natural person purchasing mainly for purposes outside their trade, business, craft or profession, together with any person entitled to equivalent mandatory consumer protection under applicable law.

Customer means any person placing an Order.

Customized Product means a non-prefabricated Product manufactured according to the Customer's individual specifications or clearly personalized for that Customer, for example using individual measurements, customer photographs, artwork, logos, text or individually requested modifications. A Product does not become a Customized Product merely because Keyshorts manufactures it after receiving an Order or because the Customer selects from standard options offered by Keyshorts.

Mandatory Consumer Law means any consumer-protection provision applicable to an Order that cannot legally be excluded or restricted by contract.

Order means an order submitted to Keyshorts.

Product means a physical product sold by Keyshorts.

Store means any of the following Keyshorts websites to which these Terms apply: https://keyshorts.com, https://keyshorts.eu and its localized versions, https://keyshorts.pl

2. Scope and mandatory consumer rights

These Terms govern contracts for Products sold by Keyshorts.

Polish law governs the contract.

However, this choice of law does not deprive a Consumer of protection provided by mandatory provisions of the law that would apply to the Consumer in the absence of this choice.

If Mandatory Consumer Law gives the Consumer greater rights than these Terms, Mandatory Consumer Law prevails.

Nothing in these Terms excludes or restricts a consumer right, remedy, guarantee or liability that cannot legally be excluded or restricted.

3. Products and customer specifications

The main characteristics of each Product are shown before the Order is placed.

All Keyshorts Products are manufactured only after an Order is received.

Where production requires information from the Customer, the Customer must provide accurate information, including - where applicable - the device model, dimensions, photographs, artwork, or other specifications.

Production may be delayed until necessary information has been received.

The Customer must have the right to provide any artwork, photographs, logos or other material submitted for production.

Nothing in this section limits the Customer's rights where Keyshorts fails to manufacture the Product according to the agreed specifications or the Product is otherwise defective or non-conforming.

4. Prices and payment

The Product price, applicable taxes collected by Keyshorts, shipping charges, and any other mandatory charges collected by Keyshorts are shown before the Customer places the Order.

Where import VAT, customs duties or other import charges may instead be payable by the recipient, the Customer agrees to make such payments.

Available payment methods are shown at checkout and may include payment cards, PayPal, Mollie, Klarna, or other payment services.

Payment methods are provided by:

  • Stripe Inc., 510 Townsend Street, San Francisco, CA 94103, US;
  • PayPal (Europe) S.à r.l. et Cie, S.C.A., Boulevard Royal 2449, Luxembourg, Luxembourg;
  • Apple Pay, serviced by Apple Distribution International, Hollyhill Industrial Estate, Hollyhill, Cork, Republic of Ireland;
  • Mollie (seen in checkout as Sofort, iDEAL, Bancontact, EPS, Giropay, KBC, Klarna), serviced by Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, the Netherlands;
  • Przelewy24, serviced by PayPro SA, Pastelowa 8, 60-198 Poznań, Poland.

Third-party payment providers may apply their own terms to the payment service.

5. Orders and contract formation

Before placing the Order, the Customer can review and correct the Order and see the total amount payable.

The final checkout action indicates that placing the Order creates an obligation to pay.

The Customer submits an offer to purchase the Products.

The contract is formed when Keyshorts accepts the Order and sends confirmation of acceptance, unless applicable Mandatory Consumer Law provides otherwise.

Keyshorts may refuse or cancel an Order for a legitimate reason, including inability to manufacture the Product, lack of required specifications, failed payment, an obvious pricing error, suspected fraud or illegality.

If Keyshorts cancels an Order after payment, the amount paid will be refunded without undue delay.

6. Order History and Order Status

Customers may cancel eligible Orders and initiate eligible returns on these pages:

Providing an email address is necessary to correctly display the Order history for a particular Customer.

7. Delivery

Available delivery methods, shipping prices, and the expected production and delivery period are shown before the Order is placed.

Keyshorts will deliver within the period agreed with the Customer or within any mandatory default period applicable under Consumer Law.

For Consumers, the risk of loss or damage passes at the time required by Mandatory Consumer Law.

If Keyshorts cannot deliver as agreed, the Consumer retains all mandatory rights concerning delayed or failed delivery.

8. Reviews

We send automated review requests to each customer after a certain time has passed since placing an order. These reviews are verified by order number and unique link and are marked with "Verified Buyer" caption on our Reviews page. Any person can also review us by clicking on "Write a review" button on our Reviews page. These reviews aren't verified. All reviews are published, unless the review is obviously spammy or isn't related to our services and products. You may notice some reviews throughout our website. These are selected verified reviews taken from our Reviews page, though they are not necessarily marked as verified.

9. Defective or non-conforming Products

Consumers have all statutory rights relating to defective, unsafe, misdescribed or non-conforming Products under Mandatory Consumer Law.

These statutory rights are separate from the Keyshorts Commercial Warranty.

A complaint may be submitted through the Customer Account, by e-mail to the relevant Store address, or by post to Keyshorts.

Keyshorts may reasonably request:

  • information identifying the Order;
  • a description of the problem;
  • photographs or other evidence where reasonably necessary to assess the issue.
Keyshorts will provide any repair, replacement, price reduction, refund or other remedy required by applicable law.

10. Change-of-mind returns

Keyshorts does not provide a general contractual right to return a non-defective Product merely because the Customer changes their mind unless:

  • Mandatory Consumer Law provides such a right; or
  • Keyshorts expressly offered an additional return right before purchase.

The specific statutory cancellation rules below prevail where applicable.

11. EU and EEA Consumers — withdrawal

If you are a Consumer in the European Union, Iceland or Norway, this section applies to the extent required by applicable law.

Except where a statutory exception applies, the Consumer may withdraw from an eligible distance sales contract without giving a reason within 14 calendar days after receiving the Product.

The Consumer may notify Keyshorts by e-mail, through an available statutory online withdrawal function, through an eligible Account function, by post or by another legally permitted method.

After withdrawal, the Consumer must normally return the Product within 14 days.

The Consumer bears the direct cost of returning a non-defective Product following a statutory change-of-mind withdrawal where Keyshorts properly informed the Consumer of that obligation before purchase.

Keyshorts will refund the amounts required by law, including the cost of the least expensive standard delivery method offered, without undue delay and normally within 14 days after being informed of the withdrawal.

Keyshorts may withhold reimbursement until it receives the returned Product or evidence that the Product has been sent back, whichever occurs first.

The Consumer is responsible only for diminished value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the Product.

12. EU Consumers — harmonised legal guarantee notice

If you are a Consumer in the European Union, this applies.

The harmonised notice concerns the Consumer's statutory legal guarantee. It is separate from the voluntary Keyshorts 2-Year Commercial Warranty below.

13. Keyshorts 2-Year Commercial Warranty

Keyshorts provides Consumers with a free 2-Year Commercial Warranty on Keyshorts Products, except for Products sold to Consumers in the United States or Australia.

Duration

The warranty lasts for 2 years from delivery.

Coverage

The warranty covers defects in materials or workmanship arising during normal intended use.

For a valid warranty claim, Keyshorts will normally replace the defective Product free of charge.

If replacement is not reasonably possible, Keyshorts will refund the price paid for the affected Product.

Exclusions

The warranty does not cover:

  • normal wear and tear;
  • accidental damage;
  • misuse or improper storage;
  • damage caused by incorrect installation, removal or reinstallation by the Customer, unless caused by incorrect Keyshorts instructions;
  • damage caused by liquids, excessive heat, chemicals or abrasive cleaning materials;
  • modifications made after delivery;
  • a Product correctly manufactured according to incorrect measurements, photographs, artwork, device information or other specifications supplied or approved by the Customer.

These exclusions apply only to the voluntary warranty and do not restrict statutory consumer rights.

Warranty claims

Claims may be submitted to the support e-mail for the Store used.

The Customer should provide information identifying the Order, a description of the problem and, where reasonably necessary, photographs.

A physical return is not needed.

Statutory rights

Consumers are entitled by law to remedies from the Seller free of charge where goods do not conform to the contract. Those statutory remedies are not affected by this Commercial Warranty.

Where required by law, this warranty statement will be supplied on a durable medium no later than delivery.

14. France

If you are a French Consumer, this applies.

 

Le consommateur dispose d'un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d'apparition d'un défaut de conformité. Durant ce délai, le consommateur n'est tenu d'établir que l'existence du défaut de conformité et non la date d'apparition de celui-ci.

Lorsque le contrat de vente du bien prévoit la fourniture d'un contenu numérique ou d'un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n'est tenu d'établir que l'existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d'apparition de celui-ci.

La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.

La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.

Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d'une extension de six mois de la garantie initiale.

Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.

Le consommateur peut obtenir une réduction du prix d'achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :

1° Le professionnel refuse de réparer ou de remplacer le bien ;

2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;

3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;

4° La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.

Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu'il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n'est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.

Le consommateur n'a pas droit à la résolution de la vente si le défaut de conformité est mineur.

Toute période d'immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu'à la délivrance du bien remis en état.

Les droits mentionnés ci-dessus résultent de l'application des articles L. 217-1 à L. 217-32 du code de la consommation.

Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d'un montant maximal de 300 000 euros, qui peut être porté jusqu'à 10 % du chiffre d'affaires moyen annuel (article L. 241-5 du code de la consommation).

Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le bien est conservé ou à un remboursement intégral contre restitution du bien.

15. Netherlands

If you are a Dutch Consumer, this applies.

Keyshorts offers Klarna, which allows payment after purchase or payment in installments, subject to Klarna's terms and eligibility assessment.

Dutch statutory conformity rights are not limited to the two-year duration of the Keyshorts Commercial Warranty.

16. Poland

If you are a Polish Consumer, this applies.

Keyshorts is liable for the lack of conformity of goods in accordance with the Polish Consumer Rights Act.

Where required by Polish law, Keyshorts responds to a Consumer complaint within 14 days.

The relevant consumer protections also apply, to the extent required by Polish law, to a natural person entering into a contract directly connected with that person's business where the contract is not professional in character for that person.

Providing a NIP or requesting a business invoice does not by itself remove those statutory protections.

17. Québec, Canada

If you are a Québec Consumer, this applies.

For an online distance contract, Keyshorts will provide the Consumer with a copy of the contract capable of being easily retained and printed within 15 days after conclusion, containing the information required by Québec law.

Any statutory cancellation rights arising because required information or a compliant contract copy was not supplied remain unaffected.

18. Israel

If you are an Israeli Consumer, this applies.

For an eligible distance sale, the Consumer may cancel within 14 days from the transaction or receipt of the required transaction disclosure document, whichever is later, subject to statutory exceptions.

Keyshorts will refund the amounts required by law within 14 days after receiving the cancellation notice.

No cancellation fee is charged.

For qualifying products made according to individual sizes or special requirements, the statutory customized-product rules apply. The cancellation right may apply during the first three days and thereafter only if production has not begun, as provided by Israeli law.

Where Israeli law grants an extended cancellation period to an eligible senior citizen, new immigrant or person with a disability, that statutory period applies.

Keyshorts permits statutory cancellation by the methods required by Israeli law, including the online cancellation method where required.

19. South Korea

If you are a South Korean Consumer, this applies.

For an eligible distance sale, the Consumer generally has a statutory cancellation period of 7 days from receipt of the required contract information or, where delivery occurs later, from the applicable date after supply.

Where the Product differs from the contract or advertising, the additional statutory cancellation periods apply, including the applicable 3-month / 30-day rules.

Refunds following a valid statutory withdrawal will be made within the mandatory Korean period.

20. Taiwan

If you are a Taiwanese Consumer, this applies.

For an eligible distance sale, the Consumer generally has 7 days after receiving the Product to rescind the contract without giving a reason or bearing the expenses prohibited by Taiwanese law.

Keyshorts will comply with the statutory collection and refund periods following a valid rescission.

21. United States and Australia

If you are a United States or Australian Consumer, the Keyshorts 2-Year Commercial Warranty does not apply.

All mandatory rights, statutory guarantees, implied warranties and remedies that apply to the purchase remain unaffected.

Nothing in these Terms excludes or restricts a right that cannot lawfully be excluded or restricted.

22. Other Consumer Countries

For Consumers in Austria, Belgium, Germany, Ireland, Italy, Spain, Iceland, Norway, Canada outside Québec, Hong Kong, New Zealand, Singapore and Switzerland, the mandatory consumer rights provided by the applicable law remain fully effective.

Keyshorts does not contractually replace, shorten or exclude those rights.

No additional contractual change-of-mind return right is provided except where stated in these Terms or offered before the Order is placed.

23. Privacy and copyright

By ordering our Products, Customers agree to our collecting and processing of their personal information. Providing this data is voluntary, but required to properly fulfill your Order. All detailed info about the privacy policy, cookies, and how we use your data can be found in the Privacy Policy pages.

Names of apps and device manufacturers are registered names or trademarks of third parties. They are used solely to identify items in this store and their use. Our Products are not endorsed or sponsored by any of these parties, and we're not affiliated with them in any way.

24. Governing law and courts

The contract is governed by Polish law, subject to the mandatory consumer-law protection described in Section 2.

Disputes are determined by the courts having jurisdiction under applicable law.

Nothing in these Terms requires a Consumer to bring proceedings exclusively in Poland, where mandatory jurisdiction rules give the Consumer a right to use another competent court.

25. Final provisions

The version of these Terms applicable to an Order is the version in force when the contract is concluded.

Changes to these Terms apply only to future Orders unless applicable law requires otherwise.

If any provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
